HOUSE BILL NO. 103

A BILL FOR AN ACT ENTITLED: "AN ACT SUBMITTING TO THE QUALIFIED ELECTORS OF MONTANA AN AMENDMENT TO ARTICLE V, SECTION 4, OF THE MONTANA CONSTITUTION TO REQUIRE A CANDIDATE FOR THE LEGISLATURE TO BE A RESIDENT OF THE DISTRICT; AND PROVIDING A DELAYED EFFECTIVE DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     Section 1.  Article V, section 4, of The Constitution of the State of Montana is amended to read:

            "Section 4.  Qualifications. A candidate for the legislature shall be a resident of the state for at least one year next preceding the general election. For six months next preceding the general election, he shall be a resident of the county if it contains one or more districts or of the district if it contains all or parts of more than one county."

 

     NEW SECTION.  Section 2.  Effective date. If approved by the electorate, this amendment is effective July 1, 2013.

 

     NEW SECTION.  Section 3.  Submission to electorate. This amendment shall be submitted to the qualified electors of Montana at the general election to be held in November 2008 by printing on the ballot the full title of this act and the following:

     []     FOR requiring a candidate for the legislature to be a resident of the district.

     []     AGAINST requiring a candidate for the legislature to be a resident of the district.
