A BILL FOR AN ACT ENTITLED: "AN ACT REQUIRING THE DEPARTMENT OF TRANSPORTATION TO GRADUALLY INCREASE THE FUEL ECONOMY OF VEHICLES IN THE STATE MOTOR POOL; AMENDING SECTION 2-17-411, MCA; AND PROVIDING AN APPLICABILITY DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     Section 1.  Section 2-17-411, MCA, is amended to read:

     "2-17-411.  Motor pool -- department of transportation -- vehicle fuel economy -- exceptions. (1) The department of transportation's motor pool is responsible for the acquisition, operation, maintenance, repair, and administration of all motor vehicles in the custody of the motor pool.

     (2) (a) Whenever the department of transportation replaces a vehicle in the motor pool, the fuel economy of the replacement vehicle must be at least 5% greater than the fuel economy of the vehicle replaced. If more than one vehicle is replaced at one time, the average fuel economy of the replacement vehicles must be at least 5% greater than the average fuel economy of the vehicles replaced.

     (b) Whenever the department of transportation purchases a vehicle for the motor pool that is not a replacement for a vehicle already in the motor pool, the fuel economy of the newly purchased vehicle must be at least 5% greater than the average fuel economy of similar vehicles in the motor pool.

     (c) For the purposes of this section, the fuel economy of a vehicle is the appropriate figure listed in the Fuel Economy Guide published by the U.S. department of energy or the average fuel economy determined by the U.S. department of transportation pursuant to 49 U.S.C. 32901, et seq. If the fuel economy of a vehicle or a category of vehicles is not published, the department of transportation shall determine the fuel economy of the vehicle or group of vehicles in a manner the department of transportation considers to be consistent with the purpose of this subsection (2).

     (2)(3)  This part does not apply to a motor vehicle used in the service of the governor, the attorney general, or the highway patrol."

 

     NEW SECTION.  Section 2.  Applicability. [This act] applies to vehicles for which an invitation for bids was issued on or after [the effective date of this act] and that were purchased by the department of transportation for the motor pool after [the effective date of this act].
