HOUSE BILL NO. 221

A BILL FOR AN ACT ENTITLED: "AN ACT SUBMITTING TO THE QUALIFIED ELECTORS OF MONTANA AN AMENDMENT TO ARTICLE V, SECTION 2, AND ARTICLE V, SECTION 3, OF THE MONTANA CONSTITUTION TO PROVIDE FOR THE REDUCTION OF THE SIZE OF THE LEGISLATURE IN THE NEXT REDISTRICTING CYCLE; AND PROVIDING AN APPLICABILITY PROVISION."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     Section 1.  Article V, section 2, of The Constitution of the State of Montana is amended to read:

            "Section 2.  Size. The size of the legislature shall be provided by law, but the senate shall not have more than 50 or fewer than 40 members and the house shall not have more than 100 or fewer than 80 members."

 

     Section 2.  Article V, section 3, of The Constitution of the State of Montana is amended to read:

            "Section 3.  Election and terms. A member of the house of representatives shall be elected for a term of two years and a member of the senate for a term of four years each to begin on a date provided by law. One-half Except when the size of the legislature is changed pursuant to Article V, section 2, one-half of the senators shall be elected every two years."

 

     NEW SECTION.  Section 3.  Submission to electorate. This amendment shall be submitted to the qualified electors of Montana at the general election to be held in November 2008 by printing on the ballot the full title of this act and the following:

     []      FOR reducing the size of the legislature.

     []      AGAINST reducing the size of the legislature.

 

     NEW SECTION.  Section 4.  Applicability. This amendment applies to legislative districts drawn to implement the federal decennial census in 2012.
