HOUSE BILL NO. 265

AN ACT CLARIFYING THAT AN ACTION OF A PLANNING BOARD IS NOT OFFICIAL UNLESS AUTHORIZED BY A MAJORITY OF THE QUORUM PRESENT AT THE MEETING; AMENDING SECTION 76-1-304, MCA; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     Section 1.  Section 76-1-304, MCA, is amended to read:

     "76-1-304.  Quorum -- official action. (1) A majority of members shall constitute constitutes a quorum.

     (2)  No An action of the planning board is not official, however, unless a quorum is present and unless the action is authorized by a majority of members of the board the quorum at a regular or properly called special meeting."

 

     Section 2.  Effective date. [This act] is effective on passage and approval.
