A BILL FOR AN ACT ENTITLED: "AN ACT ALLOWING A STATE PUBLIC AGENCY WHENEVER PROCURING FOOD FOR HUMAN CONSUMPTION TO SPECIFY THAT THE FOOD MUST BE PRODUCED OR PROCESSED IN MONTANA; AMENDING SECTION 18-4-232, MCA; AND PROVIDING AN EFFECTIVE DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     Section 1.  Section 18-4-232, MCA, is amended to read:

     "18-4-232.  Specifications -- rules. (1) The department shall adopt rules governing the preparation, maintenance, and content of specifications for supplies and services required by the state.

     (2) (a) Except as provided in subsection (2)(b), whenever a public agency seeks to procure food for human consumption, the specifications for the food may, at the discretion of the public agency procuring the food, include a requirement that the food be produced or processed in Montana.

     (b) Subsection (2)(a) does not apply if the food is procured with funds that prohibit a specification that the food to be procured must be produced or processed in Montana.

     (2)(3)  The department shall prepare, issue, revise, maintain, and monitor the use of specifications for supplies and services required by the state."

 

     NEW SECTION.  Section 2.  Effective date. [This act] is effective July 1, 2007.
