A BILL FOR AN ACT ENTITLED: "AN ACT CLARIFYING THAT COMPARATIVE NEGLIGENCE PRINCIPLES APPLY TO EMPLOYERS PROVIDING AND MAINTAINING SAFE PLACES OF EMPLOYMENT; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Comparative negligence. The comparative negligence principles in Title 27, chapter 1, part 7, apply to any claims against an owner or lessee or any contractor, subcontractor, or builder hired by the owner or lessee who is subject to the requirements of this chapter.

 

     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 50, chapter 71, part 2, and the provisions of Title 50, chapter 71, part 2, apply to [section 1].

 

     NEW SECTION.  Section 3.  Effective date. [This act] is effective on passage and approval.
