A BILL FOR AN ACT ENTITLED: "AN ACT REQUIRING AN INSPECTION PERMIT FOR SANITARY PLUMBING OR POTABLE WATER SUPPLY PIPING INSTALLATIONS IN NEW SINGLE-FAMILY RESIDENCES WITH CERTAIN CONDITIONS; PROVIDING THAT AN OWNER OF RESIDENTIAL PROPERTY MAY REPLACE A WATER HEATER OR INSTALL APPLIANCES WITHOUT A PLUMBING PERMIT; AND AMENDING SECTION 50-60-506, MCA."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     Section 1.  Section 50-60-506, MCA, is amended to read:

     "50-60-506.  Exceptions to permit requirement. (1) A permit is not required for any minor replacement or repair work, the performance of which does not have a significant potential for creating a condition hazardous to public health and safety.

     (2) (a) A Except as provided in subsection (2)(b), a permit is not required where when the installation is exempt under the provisions of 37-69-102 or 50-60-503.

     (b) (i) The owner of a single-family residence who is exempt from licensing under 37-69-102 for installation of sanitary plumbing or potable water supply piping in the owner's own single-family residence shall obtain a permit if:

     (A) the single-family residence is new construction;

     (B) the plumbing or piping may be covered by walls, floors, or ceilings; and

     (C) the residence is connected to a public water supply or public sewage disposal system.

     (ii) An owner who is licensed under Title 37, chapter 69, is not required to obtain a permit for any installation described in subsection (2)(b)(i).

     (3)  A state permit is not required whenever the installation occurs in an area governed by a county, city, or town and where when there is in effect a county, city, or town building code that covers plumbing installations and that provides inspection procedures.

     (4)  This part does not prohibit the owner of residential property from making an installation for all sanitary plumbing and potable water supply piping replacing a water heater or installing appliances without a permit if the owner personally does the work.

     (5)  The provisions of this part do not apply to regularly employed maintenance personnel doing maintenance work on the business premises of their employer unless the work is subject to the permit provisions of this part."
