A BILL FOR AN ACT ENTITLED: "AN ACT MAKING IT A FELONY OFFENSE FOR A PERSON WHO IS NOT ENTITLED TO REGISTER TO VOTE TO REGISTER TO VOTE OR TO VOTE IN AN ELECTION; AND AMENDING SECTION 13-35-209, MCA."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Nonresident registering to vote and voting -- felony. (1) An individual who is not a resident of Montana who knowingly falsifies the individual's identity to register to vote and votes in an election in this state is guilty of a felony offense.

     (2) An individual who is not a citizen of the United States who knowingly registers to vote in an election in this state is guilty of a felony offense and upon conviction shall be punished as provided by law.

     (3) An individual convicted of violating subsection (1) or (2) upon conviction shall be punished as provided in 46-18-213.

 

     Section 2.  Section 13-35-209, MCA, is amended to read:

     "13-35-209.  Fraudulent registration. (1) No A person may not knowingly cause, procure, or allow himself to be registered in the official register of to vote in any election district of any county knowing himself that the person is not to be entitled to such registration register.

     (2)  No A person may not falsely personate impersonate another and cause the impersonated person so personated to be registered to vote.

     (3)  When, on the trial of the person charged with any offense under the provisions of this section, it appears in evidence that the accused stands is registered in the register of to vote in any county without being qualified for such registration, the court shall order such the registration canceled.

     (4) A person who violates the registration provisions of [section 1] or this section is guilty of a felony and upon conviction shall be punished as provided in 46-18-213."

 

     NEW SECTION.  Section 3.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 13, chapter 2, part 2, and the provisions of Title 13, chapter 2, part 2, apply to [section 1].
