A BILL FOR AN ACT ENTITLED: "AN ACT PROVIDING FOR A DEATH OR DISABILITY BENEFIT FOR FEDERAL AERIAL FIREFIGHTERS; AND PROVIDING AN APPLICABILITY DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Federal aerial firefighter death or disability benefit. (1) A person who is killed or permanently and totally disabled while serving as a pilot or crew member of an aircraft on a firefighting mission in Montana while under service to an agency of the federal government or while serving under a contract or subcontract with an agency of the federal government is entitled to a benefit of $283,000. The benefit must be paid whether or not the person received compensation for the service. The benefit must be paid by the department of natural resources and conservation. The benefit must be reduced by the amount of any benefit paid or to be paid by an agency of the federal government for the same reason that a benefit is paid under this section. The benefit must be paid to the person if the person is disabled and to the person's estate if the person is killed.

     (2) The department may adopt rules to implement this section.

 

     NEW SECTION.  Section 2.  Applicability. [This act] applies to deaths and disabilities occurring after [the effective date of this act].
