A BILL FOR AN ACT ENTITLED: "AN ACT PROVIDING FOR ADMINISTRATIVE RULE REVIEW COMMITTEE NULLIFICATION OF A PROPOSED OR ADOPTED RULE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1. Committee nullification of proposed or adopted rule. Upon the request of any person or a committee member, an administrative rule review committee may, after a public hearing and by a majority vote, disapprove of a rule adopted since final adjournment of the last regular session of the legislature or of a proposed rule. If disapproved, a rule that has been adopted ceases to be effective and a proposed rule is not effective if adopted.

 

     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 2, chapter 4, part 4, and the provisions of Title 2, chapter 4, apply to [section 1].
