A BILL FOR AN ACT ENTITLED: "AN ACT PROHIBITING THE BOARD OF TRUSTEES OF A SCHOOL DISTRICT RECEIVING STATE MONEY FROM USING THAT MONEY TO DIRECTLY OR INDIRECTLY SUPPORT LITIGATION TO OBTAIN ADDITIONAL STATE FUNDING WITHOUT PRIOR VOTER APPROVAL; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE AND A TERMINATION DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Use of state money for funding litigation prohibited without voter approval -- penalty. (1) The board of trustees of a school district receiving state money may not expend that money to directly or indirectly support litigation to obtain additional state funding without prior voter approval.

     (2) If a legislative audit determines that the trustees of a school district have expended state funds in violation of this section, the superintendent of public instruction shall withhold from the district in the succeeding fiscal year a payment of state funds that is equal to that spent without voter approval.

 

     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 20, chapter 3, part 3, and the provisions of Title 20, chapter 3, part 3, apply to [section 1].

 

     NEW SECTION.  Section 3.  Effective date. [This act] is effective on passage and approval.

 

     NEW SECTION.  SECTION 4.  TERMINATION. [THIS ACT] TERMINATES JUNE 30, 2013.
