A BILL FOR AN ACT ENTITLED: "AN ACT REVISING THE LAW GOVERNING THE COMPENSATION OF SCHOOL DISTRICT TRUSTEES; PROVIDING FOR COMPENSATION FOR SCHOOL DISTRICT TRUSTEES; AUTHORIZING SCHOOL DISTRICT TRUSTEES TO PARTICIPATE IN SCHOOL DISTRICT HEALTH INSURANCE POLICIES; AMENDING SECTION 20-3-311, MCA; AND PROVIDING AN EFFECTIVE DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     Section 1.  Section 20-3-311, MCA, is amended to read:

     "20-3-311.  Trustee travel reimbursement and compensation of -- secretary for joint board. (1) (a) The members of the trustees of any district shall not may receive compensation for their services as trustees,. except that the The secretary of the trustees of a high school district operating a county high school or the secretary of a joint board of trustees may be compensated for his the services as the secretary.

     (b) The members of the trustees who reside over 3 miles from the trustees' meeting place shall must be reimbursed at the rate as provided in 2-18-503, for every mile necessarily traveled between their residence and the meeting place and return in attending the regular and special meetings of the trustees, and all trustees shall must be similarly reimbursed for meetings called by the county superintendent. The travel reimbursement may be accumulated during the school fiscal year and paid at the end of the fiscal year, at the discretion of each trustee.

     (2) (a) The total compensation of school district trustees is as follows:

     (i) For school districts that include towns or cities of the third class that have a population of less than 3,000 or school districts that do not include a city or town, the annual salary of a trustee may not exceed $500. For school districts that include cities of the third class that have a population of 3,000 or more, the annual salary of a trustee may not exceed $800.

     (ii) For school districts that include cities of the second class, the annual salary of a trustee may not exceed $1,500.

     (iii) For school districts that include cities of the first class that have a population of less than 30,000, the annual salary of a trustee may not exceed $3,500. For school districts that include cities of the first class that have a population of 30,000 or more, the annual salary of a trustee may not exceed $4,000.

     (b) If a school district includes a city of more than one class, the trustees may be compensated at the level for a district containing the largest city.

     (3) An increase in salary for trustees occasioned by the advance in class or increase in population of any city must commence with the month following the publication of the census showing the advance in class or increase in population.

     (4) School district health insurance policies must provide for coverage of trustees on the same terms and conditions available to school district employees.

     (5) The salary of school district trustees must be fixed by the trustees and is payable monthly or at shorter time periods as prescribed by the board of trustees.

     (6) For the purposes of this section, the classes of cities are determined pursuant to 7-1-4111."

 

     NEW SECTION.  Section 2.  Effective date. [This act] is effective July 1, 2007.
