A BILL FOR AN ACT ENTITLED: "AN ACT MAKING UNAUTHORIZED PRACTICE BEFORE A COURT A CRIMINAL OFFENSE AND PROVIDING PENALTIES; AND AMENDING SECTION 37-61-210, MCA."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     Section 1.  Section 37-61-210, MCA, is amended to read:

     "37-61-210.  Penalty for practicing without license unauthorized practice before court. (1) If any person practices law in any court, except a justice's court, or a city court, or water court, without authorization or having received a license as attorney and counselor, he that person is guilty of a contempt of court unauthorized practice before a court.

     (2) A person convicted of the offense of unauthorized practice before a court shall be fined not to exceed $500 or be imprisoned in the county jail for a term not to exceed 6 days, or both."
