A BILL FOR AN ACT ENTITLED: "AN ACT PROVIDING FOR CERTAIN FUND TRANSFERS; AND PROVIDING AN EFFECTIVE DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Fund transfers. (1) The amount of $3 million is transferred from the state general fund to the department of commerce to be deposited in the mobile home revolving loan account in the state special revenue fund.

     (2) The amount of $5 $2 million is transferred from the state general fund to the department of commerce to be deposited in the affordable housing revolving loan account, provided for in 90-6-133, in the housing authority enterprise fund.

     (3) THE AMOUNT OF $10 MILLION IS TRANSFERRED FROM THE SCHOOL FACILITY IMPROVEMENT ACCOUNT IN THE STATE SPECIAL REVENUE FUND PROVIDED FOR IN [SECTION 1 OF HOUSE BILL NO. 417] TO THE OFFICE OF PUBLIC INSTRUCTION TO BE DEPOSITED IN THE SCHOOL FLEXIBILITY ACCOUNT IN THE STATE SPECIAL REVENUE FUND PROVIDED FOR IN 20-9-542.

 

     NEW SECTION.  Section 2.  Contingent voidness. (1) If House Bill No. 820 is not passed and approved in a form that appropriates at least $3 million to the department of commerce from the mobile home revolving loan state special revenue account, then [section 1(1)] is void.

     (2) IF HOUSE BILL NO. 809 IS NOT PASSED AND APPROVED IN A FORM THAT APPROPRIATES AT LEAST $10 MILLION TO THE OFFICE OF PUBLIC INSTRUCTION FROM THE SCHOOL FLEXIBILITY ACCOUNT IN THE STATE SPECIAL REVENUE FUND, THEN [SECTION 1(3)] IS VOID.

 

     NEW SECTION.  Section 3.  Effective date. [This act] is effective July 1, 2007.
