A BILL FOR AN ACT ENTITLED: "AN ACT ALLOWING A STATE EMPLOYEE TO RECEIVE ADDITIONAL COMPENSATION IF THE EMPLOYEE MANAGES SIX OR MORE EMPLOYEES; DISALLOWING STATE EMPLOYEES WHO SUPERVISE FIVE OR FEWER EMPLOYEES FROM RECEIVING ADDITIONAL COMPENSATION; REDUCING FUNDING FOR PERSONAL SERVICES FOR AGENCIES WITH 50 FULL-TIME EQUIVALENTS UNDER CERTAIN CONDITIONS; AND PROVIDING AN EFFECTIVE DATE AND AN APPLICABILITY DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Managers of five or fewer employees -- compensation. (1) An employee who supervises or manages six or more employees may receive additional compensation for performing those duties.      

     (2) An employee who supervises or manages five or fewer employees may not receive additional compensation based solely on the employee's supervisory or managerial responsibilities.

 

     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 2, chapter 18, part 3, and the provisions of Title 2, chapter 18, part 3, apply to [section 1].

 

     COORDINATION SECTION.  Section 3.  Coordination instruction. If both House Bill No. 2 and [this act] are passed and approved, the funding for personal services in House Bill No. 2 for each agency with 50 or more full-time equivalents that is not excepted under 2-18-103 is reduced by the amount of compensation received by employees who manage or supervise five or fewer employees.

 

     NEW SECTION.  Section 4.  Effective date. [This act] is effective July 1, 2017.

 

     NEW SECTION.  Section 5.  Applicability. [This act] applies to increases to an employee's compensation made on or after July 1, 2017. An individual employee's compensation may not be reduced under [this act].
