HOUSE JOINT RESOLUTION NO. 19

A JOINT RESOLUTION OF THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE STATE OF MONTANA REQUESTING AN INTERIM STUDY COMPARING MONTANA TRAFFIC LAWS TO THE UNIFORM VEHICLE CODE.

 

     WHEREAS, there has not been an interim study on uniform traffic laws since the 2001-2002 interim; and

     WHEREAS, traffic regulation statutes contained in Title 61, chapter 8, of the Montana Code Annotated have ambiguities that warrant clarification; and

     WHEREAS, traffic laws have not kept current with the revisions in the Uniform Vehicle Code; and

     WHEREAS, it is in the public's interest for there to be clarity and uniformity in the state's traffic laws.

 

NOW, THEREFORE, BE IT RESOLVED BY THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE STATE OF MONTANA:

     That the Legislative Council be requested to designate an appropriate interim committee, pursuant to section 5-5-217, MCA, to:

     (1) study the existing traffic laws contained in Title 61, chapter 8, Montana Code Annotated, to identify areas of ambiguity;

     (2) compare existing traffic laws to the current version of the Uniform Vehicle Code; and

     (3) identify differences between the laws contained in Title 61, chapter 8, Montana Code Annotated, and the provisions of the Uniform Vehicle Code for the purposes of preparing legislation to present to the 66th Legislature.

     BE IT FURTHER RESOLVED, that the input of the Department of Transportation, the Department of Justice, local government representatives, and other interested persons be sought in the process of evaluating the current traffic laws and recommending changes to those laws.

     BE IT FURTHER RESOLVED, that all aspects of the study, including presentation and review requirements, be concluded prior to September 15, 2018.

     BE IT FURTHER RESOLVED, that the final results of the study, including any findings, conclusions, comments, or recommendations of the appropriate committee, be reported to the 66th Legislature.
