A BILL FOR AN ACT ENTITLED: "AN ACT REQUIRING A REDUCTION IN THE USE OF CHLORIDE-BASED LIQUID DE-ICERS ON PUBLIC HIGHWAYS."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Limits on chloride-based liquid de-icers. (1) Except as provided in subsections (2) and (3), liquid de-icers containing sodium chloride or magnesium chloride may be used on public highways in Montana between December 1 and March 31 of each year.

     (2) The use of chloride-based liquid de-icers on public highways or sections of public highways must be reduced from the current level of use by 10% each year over the 10 years following [the effective date of this act] or until the use of chloride-based liquid de-icers reverts to the mean average use over the period from December 1, 2007, through March 31, 2010, whichever occurs first.

     (3) The provisions of this section do not apply to the use of a 10% rock salt base mixed with sand.

 

     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 60, chapter 2, part 2, and the provisions of Title 60, chapter 2, apply to [section 1].
