A BILL FOR AN ACT ENTITLED: "AN ACT GENERALLY PROVIDING HOW THE SPECIAL ELECTION TO FILL THE 2017 VACANCY IN THE OFFICE OF UNITED STATES REPRESENTATIVE FOR MONTANA MAY BE CONDUCTED; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
NEW SECTION. Section 1. Special election allowable by mail. (1) Pursuant to 13-19-104(3)(b) and 13-25-203, the 2017 special election to fill the vacancy in the office of United States representative for Montana may be conducted by mail.
(2) If an election administrator conducts the election by mail:
(a) the election must be conducted under the provisions of Title 13, chapter 19, except that the written mail ballot plan under 13-19-205 must be submitted to the secretary of state at least 45 days before the election; and
(b) the election administrator shall ensure that voting systems are available at accessible sites on election day for voters with disabilities based on the number of registered electors in the county, with at least:
(i) one site for 1 to 5,000 registered electors;
(ii) two sites for 5,001 to 10,000 registered electors;
(iii) three sites for 10,001 to 20,000 registered electors; and
(iv) four sites for 20,001 or more registered electors.
NEW SECTION. Section 2. Effective date. [This act] is effective on passage and approval.
