A BILL FOR AN ACT ENTITLED: "AN ACT REVISING LAWS RELATED TO THE REAL ID ACT; DIRECTING THE DEPARTMENT OF JUSTICE TO PREPARE A PLAN TO MAKE MONTANA COMPLIANT WITH THE REAL ID ACT; DIRECTING THE DEPARTMENT TO REPORT ITS PLAN TO A LEGISLATIVE INTERIM COMMITTEE; PROVIDING FOR A FEE IMPOSED IN MOTOR VEHICLE LICENSE ISSUANCE; AND REPEALING SECTION 61-5-128, MCA."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Compliance with REAL ID Act. (1) The department shall develop a plan to implement the provisions of the REAL ID Act of 2005, as part of Public Law 109-13. The department shall report and provide updates of its plan to the appropriate legislative interim committee throughout the 2017 and 2018 interim year.

     (2) The plan developed by the department and presented to the appropriate legislative committee must include:

     (a) proposed legislation for the 2019 legislative session that would make Montana compliant with the Real ID Act by July 1, 2019;

     (b) estimated costs of making Montana compliant with the Real ID Act through implementation; and

     (c) an analysis of privacy issues relating to Montana citizens through implementation of the Real ID Act.

     (3) The appropriate legislative committee assigned to review the department's plan may prepare legislation for the 2019 legislative session that makes Montana compliant with the Real ID Act by July 1, 2019.

     (4) The department may charge up to 5 cents in the issuance or renewal of motor vehicle DRIVER'S licenses under Title 61, chapter 5, AND IDENTIFICATION CARDS UNDER TITLE 61, CHAPTER 12, PART 5, to provide for the costs of preparing the plan provided in this section. The fees must be deposited into the general fund. The department may charge the fee provided in this section until June 30, 2019.

 

     NEW SECTION.  Section 2.  Repealer. The following section of the Montana Code Annotated is repealed:

61-5-128.        & #160; Legislative finding and direction to state agency not to implement REAL ID Act.
