Coordination With Local Planning Authority

76-7-207. Coordination with local planning authority. (1) In order to minimize conflict with local comprehensive planning, the entity acquiring the environmental control easement shall provide a copy of the easement to the appropriate local planning authority for the county within which the land lies prior to or concurrently with recording.

(2) The requirement in subsection (1) to provide a copy of the environmental control easement to the local planning authority is only for the purposes of informing the authority of the easement.

(3) The failure to provide the environmental control easement to the local planning authority, as required in subsection (1), does not invalidate the easement.
