HOUSE BILL NO. 272

A BILL FOR AN ACT ENTITLED: "AN ACT REVISING ELIGIBILITY FOR BEING HONORED AT THE STATE FIREFIGHTERS' MEMORIAL; SPECIFYING THAT THE MEMORIAL MUST LIST THE NAMES OF FIREFIGHTERS KILLED IN THE LINE OF DUTY; PROVIDING THAT RETIRED FIREFIGHTERS ARE ALSO ELIGIBLE TO BE HONORED; PROVIDING FOR CERTIFICATION OF ELIGIBILITY; CLARIFYING THE ROLE OF THE MEMORIAL'S GOVERNING BOARD; AMENDING SECTION 1-1-519, MCA; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     Section 1.  Section 1-1-519, MCA, is amended to read:

     "1-1-519.  Montana state firefighters' memorial. (1) The site chosen by the city of Laurel, Montana, as "firefighters' memorial park" is officially designated as the location of the Montana state firefighters' memorial.

     (2) Subject to subsection (5), the memorial must list the names of Montana firefighters killed in the line of duty.

     (3) A Montana firefighter who has served as a firefighter for at least 20 years and has retired from that service is also eligible for recognition in the memorial park.

     (4) A firefighter's local department shall certify in writing to the memorial's governing board that the firefighter meets the eligibility requirements of subsection (2) or (3).

     (5) The memorial's governing board is the final authority for determining the names that may be listed on the memorial.

     (2)(6)  The department of commerce and the department of transportation shall identify the memorial in Laurel on official state maps and, where appropriate, on state highway signs as the official state firefighters' memorial."

 

     NEW SECTION.  Section 2.  Effective date. [This act] is effective on passage and approval.
