A BILL FOR AN ACT ENTITLED: "AN ACT REQUIRING PUBLIC UTILITIES TO BEAR THE BURDEN OF PROOF IN RATE CASES; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  General rate case -- burden of proof. If the public service commission requires a public utility to file information to demonstrate that the utility's rates and schedules conform to the requirements of 69-3-201, the public utility bears the burden of proof in demonstrating that either existing rates and schedules or requested changes to existing rates and schedules conform to the requirements of 69-3-201.

 

     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 69, chapter 3, and the provisions of Title 69, chapter 3, apply to [section 1].

 

     NEW SECTION.  Section 3.  Effective date. [This act] is effective on passage and approval.
