A BILL FOR AN ACT ENTITLED: "AN ACT REQUIRING HEALTH CARE PROVIDERS TO OFFER PATIENTS THE OPPORTUNITY TO OPT IN TO THE STATE IMMUNIZATION INFORMATION SYSTEM; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Notification -- state immunization information system. (1) A person licensed to provide health care under this title who provides immunizations as part of the person's practice of health care shall offer each patient immunized or the person's parent or guardian, if applicable, the option of providing consent to having the patient's immunization records entered into the state immunization information system.

     (2) The option must be provided each time a patient receives an immunization unless the patient has previously consented to having the immunization records entered into the system.

     (3) IF A PATIENT OR A PATIENT'S PARENT OR GUARDIAN CHOOSES TO HAVE RECORDS ENTERED INTO THE STATE IMMUNIZATION INFORMATION SYSTEM, THE PROVIDER OFFERING THE OPTION SHALL ENTER THE INFORMATION INTO THE SYSTEM.

 

     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 37, chapter 2, part 3, and the provisions of Title 37, chapter 2, part 3, apply to [section 1].

 

     NEW SECTION.  Section 3.  Effective date. [This act] is effective on passage and approval.
