A BILL FOR AN ACT ENTITLED: "AN ACT REQUIRING THE DEPARTMENT OF PUBLIC HEALTH AND HUMAN SERVICES TO PARTICIPATE IN A SECURE HEALTH INFORMATION EXCHANGE; AND ENABLING THE DEPARTMENT TO PRIVATELY AND SECURELY SHARE INFORMATION WITH THE EXCHANGE."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
NEW SECTION. Section 1. Department to participate in health care information exchange -- sharing of data. (1) The department shall participate in a secure system developed to allow for the electronic exchange of information among health care providers, facilities, and payors in order to enhance sharing of clinical information, claims data, and other information as a means to improve health outcomes for the people of this state.
(2) The department shall provide to the electronic system, as necessary and appropriate, information related to:
(a) the healthy Montana kids plan provided for in Title 53, chapter 4, part 11; and
(b) the medicaid program provided for in Title 53, chapter 6.
(3) The department may:
(a) share information under this section only with an electronic system that is able to ensure the privacy and security of the data reported to the system; and
(b) enter into any contract or agreement necessary for participating in the electronic exchange of information.
NEW SECTION. Section 2. Codification instruction. [Section 1] is intended to be codified as an integral part of Title 53, chapter 2, part 2, and the provisions of Title 53, chapter 2, part 2, apply to [section 1].
