A BILL FOR AN ACT ENTITLED: "AN ACT CLARIFYING THAT THE MONTANA MENTAL HEALTH PARITY ACT APPLIES TO DISABILITY INSURANCE; AMENDING SECTION 33-22-701, MCA; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE AND A RETROACTIVE APPLICABILITY DATE."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
Section 1. Section 33-22-701, MCA, is amended to read:
"33-22-701. Short title -- purpose -- scope of part -- exceptions. (1) This part may be cited as the "Montana Mental Health Parity Act".
(2) The purpose of this part is to ensure that Montana law applies the same level of parity between mental health and physical health benefits as existed in federal law on January 1, 2017.
(3) The provisions of this part apply to all policies and certificates of individual and group health insurance, and group health plans, and disability insurance offered to, renewed for, or issued to Montana residents by any health insurance issuer or disability insurance issuer.
(4) This part does not apply to a short-term travel policy, a blanket disability policy as defined in 33-22-601, or excepted benefits as defined in 33-22-140."
NEW SECTION. Section 2. Effective date. [This act] is effective on passage and approval.
NEW SECTION. Section 3. Retroactive applicability. [This act] applies retroactively, within the meaning of 1-2-109, to all policies and certificates offered, renewed, or issued on or after January 1, 2018.
