A BILL FOR AN ACT ENTITLED: "AN ACT REVISING LAWS RELATED TO A CANDIDATE LOANING MONEY TO THE CANDIDATE'S CAMPAIGN; PROVIDING THAT AN AFFIRMATION ON A REQUIRED REPORT IS AN AFFIRMATION THAT A CANDIDATE'S PERSONAL LOAN TO THE CANDIDATE'S CAMPAIGN IS NOT MONEY CONTRIBUTED FROM A THIRD PARTY; AND AMENDING SECTION 13-37-231, MCA."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     Section 1.  Section 13-37-231, MCA, is amended to read:

     "13-37-231.  Reports to be certified as true, complete, and correct. (1) A report required by this chapter to be filed by a candidate or political committee must be verified as true, complete, and correct by the oath or affirmation of the individual filing the report. The individual filing the report must be the candidate or an officer of a political committee who is on file as an officer of the committee with the commissioner.

     (2) The oath or affirmation of a candidate who has made a personal loan to the candidate's campaign is affirming that the loan was not made using money gifted or loaned to the candidate by a third party.

     (2)(3)  A copy of a report or statement filed by a candidate or political committee must be preserved by the individual filing it for a period coinciding with the term of office for which the person was a candidate or for a period of 4 years, whichever is longer."
