A BILL FOR AN ACT ENTITLED: "AN ACT ALLOWING BIOPTIC LENS USERS TO APPLY FOR DRIVER'S LICENSES; GRANTING RULEMAKING AUTHORITY; AND PROVIDING AN EFFECTIVE DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Use of bioptic lenses. (1) An applicant for a driver's license who uses bioptic lenses may use bioptic lenses for the eyesight test conducted pursuant to 61-5-110. An applicant who uses bioptic lenses must:

     (a) demonstrate a visual acuity of at least 20/200 in one or both eyes and a field of 70 degrees horizontal vision with or without corrective carrier lenses, or if the person has vision in one eye only, the person must demonstrate a field of at least 40 degrees temporal and 30 degrees nasal horizontal vision;

     (b) demonstrate a visual acuity of at least 20/70 in one or both eyes with the bioptic telescopic lenses and without the use of field expanders; and

     (c) provide a report of examination by an opthamologist or optometrist, on a form prescribed by the department, for the department to determine if all field of vision requirements are met or additional testing is needed.

     (2) The department may require an applicant who uses bioptic lenses to complete additional requirements provided for by rule.

     (3) The department may adopt rules to implement this section.

 

     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 61, chapter 5, part 1, and the provisions of Title 61, chapter 5, part 1, apply to [section 1].

 

     NEW SECTION.  Section 3.  Effective date. [This act] is effective July 1, 2019.
