A BILL FOR AN ACT ENTITLED: "AN ACT PROVIDING WORKER PROTECTIONS REGARDING RESTRAINT OF TRADE AGREEMENTS BY PROVIDING PENALTIES; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Penalties. An employer who violates the provisions of 28-2-703 by falsely conveying information that an employee or an independent contractor is subject to a noncompete or nonpoaching contract or agreement may be civilly liable for the penalties under 30-14-142 for unfair competition or deceptive practices as provided in 30-14-103.

 

     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 28, chapter 2, part 7, and the provisions of Title 28, chapter 2, part 7, apply to [section 1].

 

     NEW SECTION.  Section 3.  Effective date. [This act] is effective on passage and approval.
