A BILL FOR AN ACT ENTITLED: "AN ACT REVISING HIGHER EDUCATION LAWS; REQUIRING THAT STATE-SUBSIDIZED HIGHER EDUCATION PLACEMENTS BE ALLOCATED BY LOTTERY; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE AND AN APPLICABILITY DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  State-supported placements determined by lottery. (1) Any agreement entered into by an agency of the state for the placement of students in an out-of-state institution of higher education that involves a state subsidy benefiting the student must allocate state-subsidized placements by lottery.

     (2) This section may not be construed to infringe on the admitting authority of an out-of-state institution.

 

     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 20, chapter 25, part 8, and the provisions of Title 20, chapter 25, part 8, apply to [section 1].

 

     NEW SECTION.  Section 3.  Effective date. [This act] is effective on passage and approval.

 

     NEW SECTION.  Section 4.  Applicability. [This act] applies to agreements entered into or renewed on or after [the effective date of this act].
