A BILL FOR AN ACT ENTITLED: "AN ACT RESTRICTING PARKING AT ELECTRIC VEHICLE CHARGING STATIONS; PROVIDING DEFINITIONS; PROVIDING A PENALTY; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
NEW SECTION. Section 1. Electric vehicle charging stations -- parking -- penalty. (1) A person may not stop, stand, or park a nonelectric vehicle at any electric vehicle charging station.
(2) An electric vehicle charging station must be marked by a sign detailing the electric charging capability of the space and the penalty as provided in [section 3] SUBSECTION (3) for violating subsection (1) of this section.
(3) A person who parks a motor vehicle in violation of this section is guilty of a misdemeanor and is punishable by a fine of $50 $25 or towing at the motor vehicle owner's expense.
(4) As used in this section, the following definitions apply:
(a) "Electric vehicle" means a vehicle capable of electric charging at an electric vehicle charging station.
(b) "Electric vehicle charging station" means any parking space equipped to charge electric vehicles.
NEW SECTION. Section 2. Codification instruction. [Section 1] is intended to be codified as an integral part of Title 61, chapter 8, part 3, and the provisions of Title 61, chapter 8, part 3, apply to [section 1].
NEW SECTION. Section 3. Effective date. [This act] is effective on passage and approval.
