SENATE BILL NO. 214

A BILL FOR AN ACT ENTITLED: "AN ACT REQUIRING THE DEPARTMENT OF PUBLIC HEALTH AND HUMAN SERVICES TO PLAN FOR IMPROVED RESPONSE TO AND TREATMENT OF STROKES; REQUIRING MONITORING OF A DATABASE OF STROKE INFORMATION; REQUIRING CERTAIN HOSPITALS TO PARTICIPATE IN THE DATABASE; PROVIDING FOR AN OPTIONAL REPORT; AND AMENDING SECTIONS 50-17-201 AND 50-17-202, MCA."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     Section 1.  Section 50-17-201, MCA, is amended to read:

     "50-17-201.  Department monitoring of acute heart attack and stroke data -- reporting requirement. (1) The department shall undertake the following activities to achieve continuous quality improvement in the response to and treatment of acute heart attacks and strokes:

     (a)  monitor data reported to and analyses generated by a respective national data platform platforms that compile information on heart attack and stroke response and treatment, including prehospital, hospital, and posthospital measures;

     (b)  identify potential interventions or practices to improve the response to acute heart attacks and strokes in Montana or in specific regions of the state;

     (c)  work with hospitals, critical access hospitals, and emergency medical service providers on the reporting of data and on using the results of data analysis; and

     (d)  make recommendations to the legislature and to hospitals, critical access hospitals, emergency medical service providers, and health care providers on ways to improve the response to and delivery of care for acute heart attacks and strokes.

     (2)  The department shall coordinate its efforts under this part with state and national organizations involved in quality improvement for acute heart attacks and strokes in order to avoid duplication of efforts.

     (3)  The department shall establish an oversight process and implement a plan for achieving continuous quality improvement in the quality of care provided for acute heart attacks and strokes, including the system response to and the treatment of acute heart attacks and strokes."

 

     Section 2.  Section 50-17-202, MCA, is amended to read:

     "50-17-202.  Reporting and review of acute heart attack and stroke data. To improve the response to and treatment of acute heart attacks and strokes, the department shall:

     (1)  require receiving hospitals to report to the an appropriate national data platform information consistent with nationally recognized guidelines on the treatment of individuals with confirmed acute heart attacks;

     (2)  encourage hospitals, critical access hospitals, and emergency medical service providers that refer patients suffering acute heart attacks to a receiving hospital to participate in the national data platform;

     (3) require hospitals that have been certified by a national accrediting body as comprehensive stroke centers or primary stroke centers to report information on stroke care to a nationally recognized stroke registry data platform in accordance with standards developed and approved by national organizations that advance knowledge and care related to stroke response and treatment;

     (4) encourage hospitals that have been certified by a national accrediting body as acute stroke ready hospitals and emergency medical service providers to report data to the stroke registry data platform;

     (3)(5)  encourage health care professionals who provide care to patients with suffering acute heart attacks or strokes to share data and discuss ways to improve the quality of care for the patients;

     (4)(6)  encourage the use of evidence-based treatment guidelines for helping patients obtain ongoing community-based followup care in outpatient settings after discharge from a hospital; and

     (5)(7)  work with hospitals, critical access hospitals, and emergency medical service providers to develop recommendations for improving the delivery of care to patients suffering acute heart attacks or strokes."

 

     NEW SECTION.  Section 3.  Optional report on stroke data. The department may provide a report of stroke data collected pursuant to this part in accordance with the confidentiality requirements of 50-17-203. If prepared, the report must be:

     (1) posted on the department's website; and

     (2) submitted to the governor and, as provided in 5-11-210, to the legislature.

 

     NEW SECTION.  Section 4.  Codification instruction. [Section 3] is intended to be codified as an integral part of Title 50, chapter 17, part 2, and the provisions of Title 50, chapter 17, apply to [section 3].
