SENATE JOINT RESOLUTION NO. 17

A JOINT RESOLUTION OF THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE STATE OF MONTANA REQUESTING AN INTERIM STUDY OF THE COMPOSITION AND ELECTION OF THE MONTANA PUBLIC SERVICE COMMISSION.

 

     WHEREAS, the public service commission districts established in section 69-1-104, MCA, are in need of review and updates; and

     WHEREAS, districts should be updated and developed to better reflect population shifts and regulated utility customers; and

     WHEREAS, there is a need to reduce the public service commission from five commissioners to three commissioners.

 

NOW, THEREFORE, BE IT RESOLVED BY THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE STATE OF MONTANA:

     That the Legislative Council be requested to designate an appropriate interim committee, pursuant to section 5-5-217, MCA, or direct sufficient staff resources to:

     (1) review county population figures from the federal population census and examine each district based on population, county boundaries, and number of utility customers;

     (2) review options for updating and revising commission districts, including the development of maps for various options;

     (3) analyze timelines for reducing the commission from five districts to three districts without impacting existing commission terms and still providing for adequate representation; and

     (4) invite public testimony during at least two public meetings to gather input on redistricting options.

     BE IT FURTHER RESOLVED, that if the study is assigned to staff, any findings or conclusions be presented to and reviewed by an appropriate committee designated by the Legislative Council.

     BE IT FURTHER RESOLVED, that all aspects of the study, including presentation and review requirements, be concluded prior to September 15, 2020.

     BE IT FURTHER RESOLVED, that the final results of the study, including any findings, conclusions, comments, or recommendations of the appropriate committee, be reported to the 67th Legislature.
