SENATE JOINT RESOLUTION NO. 25

A JOINT RESOLUTION OF THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE STATE OF MONTANA REQUESTING AN INTERIM STUDY OF UNDEVELOPED RESIDENTIAL SUBDIVISIONS PLATTED PRIOR TO THE ENACTMENT OF THE MONTANA SUBDIVISION AND PLATTING ACT OF 1973; AND REQUIRING THAT THE FINAL RESULTS OF THE STUDY BE REPORTED TO THE 67TH LEGISLATURE.

 

     WHEREAS, the Montana Subdivision and Platting Act was enacted in 1973 to promote the public health, safety, and general welfare of Montana's citizens by regulating the subdivision of land; and

     WHEREAS, an unknown number of undeveloped subdivisions that were platted prior to the enactment of the Montana Subdivision and Platting Act exist and therefore do not meet current development standards; and

     WHEREAS, development regulations are most effective when applied consistently to all types of land development; and

     WHEREAS, these historic, undeveloped subdivisions need to be identified in order to better promote the public health, safety, and general welfare of the citizens of the state.

 

NOW, THEREFORE, BE IT RESOLVED BY THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE STATE OF MONTANA:

     That the Legislative Council be requested to designate an appropriate interim committee, pursuant to section 5-5-217, MCA, or direct sufficient staff resources to:

     (1) identify undeveloped residential subdivisions platted prior to the Montana Subdivision and Platting Act in a representative sample of not more than five counties;

     (2) seek input from appropriate stakeholders with knowledge of and an interest in subdivisions, including but not limited to county sanitarians, applicable state agencies, land use planning associations, and the land use planning staff from selected counties;

     (3) identify the current standards and statutes that govern undeveloped residential subdivisions platted prior to the Montana Subdivision and Platting Act;

     (4) examine the process required to bring these undeveloped residential subdivisions into compliance with local government subdivision regulations and the Montana Subdivision and Platting Act; and

     (5) if appropriate, develop a committee bill to address any necessary statutory revisions or additions identified in the committee's findings and recommendations.

     BE IT FURTHER RESOLVED, that if the study is assigned to staff, any findings or conclusions be presented to and reviewed by an appropriate committee designed by the Legislative Council.

     BE IT FURTHER RESOLVED, that all aspects of the study, including presentation and review requirements, be concluded prior to September 15, 2020.

     BE IT FURTHER RESOLVED, that the final results of the study, including any findings, conclusions, comments, or recommendations of the appropriate committee, be reported to the 67th Legislature.
