SENATE JOINT RESOLUTION NO. 26

INTRODUCED BY D. SANDS

 

A JOINT RESOLUTION OF THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE STATE OF MONTANA REQUESTING AN INTERIM STUDY OF THE UNIFORM PARENTAGE ACT OF 2017; AND REQUIRING A FINAL REPORT TO THE 67TH LEGISLATURE.

 

     WHEREAS, the National Conference of Commissioners on Uniform State Laws is a group of practicing lawyers, judges, legislators, and legislative staff appointed to review and develop uniform laws for consideration and adoption in all 50 states; and

     WHEREAS, the laws developed by the national conference address timely legal issues and reduce the need for individuals and businesses to deal with different state laws on similar topics as they move from state to state or do business in different states; and

     WHEREAS, the national conference has updated its Uniform Parentage Act, which was first proposed in 1973 and subsequently updated in 2002; and

     WHEREAS, Montana has substantially adopted the initial Uniform Parentage Act.

 

NOW, THEREFORE, BE IT RESOLVED BY THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE STATE OF MONTANA:

     That the Legislative Council be requested to designate an appropriate interim committee to:

     (1) study the Uniform National Parentage Act of 2017; and

     (2) make recommendations on whether or to what degree the Montana Uniform Parentage Act should be updated to reflect the changes contained in the 2017 uniform law.

     BE IT FURTHER RESOLVED, that the study include representatives of the legal system who practice in the area of family law, representatives of groups that advocate in the area of family law, and representatives of the Department of Public Health and Human Services, including but not limited to the department's Child Support Enforcement Division and Office of Vital Records.

     BE IT FURTHER RESOLVED, that all aspects of the study, including presentation and review requirements, be concluded prior to September 15, 2020.

     BE IT FURTHER RESOLVED, that the final results of the study, including any findings, conclusions, comments, or recommendations of the appropriate committee, be reported to the 67th Legislature.
