A BILL FOR AN ACT ENTITLED: "AN ACT revising laws relating to threats; Creating criminal penalties for certain threats of violence; creating the crime of issuing a credible threat of violence in a school setting; and providing penalties."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

NEW SECTION. Section 1.Issuing a credible threat of violence in a school setting. (1) A person who purposely or knowingly makes a credible threat, as defined in 45-2-101, of violence, which if carried out would result in death or serious bodily injury as defined in 45-2-101, and has taken an action in furtherance of the threat, including but not limited to bringing a weapon as defined in 45-2-101 to a school, commits the offense of issuing a credible threat of violence in a school setting.

(2) A person convicted of issuing a credible threat of violence in a school setting shall be imprisoned in a state prison for a term not to exceed 10 years or be fined an amount not to exceed $50,000, or both.

 

NEW SECTION. Section 2.Codification instruction. [Section 1] is intended to be codified as an integral part of Title 45, chapter 5, and the provisions of Title 45, chapter 5, apply to [section 1].
