A BILL FOR AN ACT ENTITLED: "AN ACT allowing certain minors to be employed as a waiter or waitress whose duty is to serve liquors, beer, or wines if permission is given by the minor's parent or legal guardian; and AMENDING SECTION 39-2-306, MCA."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

Section 1. Section 39-2-306, MCA, is amended to read:

"39-2-306. Employment of persons under 18 years of age as bartenders prohibited. (1) No Except as provided in subsection (2), a person under 18 years of age shall may not be employed as a bartender, waiter, or waitress whose duty is to serve customers purchasing liquors, beer, or wines in any establishment which sells liquors, beer, or wines at retail.

(2) A person who is 16 or 17 years of age may be employed as a waiter or waitress whose duty is to serve customers purchasing liquors, beer, or wines if written consent is provided by the person's parent or legal guardian. The consent may be withdrawn at any time.

(2)(3) Any retail vendor of liquors, beer, or wines who employs any such person under the age of 18 years is guilty of a misdemeanor."
