A joint resolution of the Senate and the House of Representatives of the state of montana to terminate the current state declaration of emergency and disaster.

 

WHEREAS, the citizens of Montana have been under a declaration of emergency and disaster in response to the COVID-19 pandemic since March 12, 2020; and

WHEREAS, citizens and businesses have been adversely affected by the orders, directives, and mandates that have been enforced in response to the Governor's declaration of emergency and disaster; and

WHEREAS, the number of reported daily new cases of COVID-19 in the state have been steadily decreasing from a high of 1,626 cases on November 13, 2020, to a total of only 32 new cases reported on February 21, 2021; and

WHEREAS, the lower number of new cases reported in Montana results in a similar reduction in active hospitalizations related to COVID-19 cases, alleviating the strain on the health care system; and

WHEREAS, pursuant to section 10-3-303(4)(c), MCA, the Governor shall terminate a state of emergency or disaster at any time the Legislature terminates the state of emergency or disaster by joint resolution.

 

Now, therefore, be it resolved by the Senate and the House of Representatives OF THE STATE OF MONTANA:

That the Legislature hereby:

(1) utilizes the power granted under section 10-3-303(4)(c), MCA, to terminate a governor's declaration of emergency or disaster at any time;

(2) terminates the declaration of emergency and disaster in response to the COVID-19 pandemic that was originally declared on March 12, 2020, and that has been subsequently renewed; and

(3) directs the Governor to rescind Executive Order No. 2-2021 and all other orders, directives, or mandates related to the declaration of emergency and disaster in response to the COVID-19 pandemic.
