A BILL FOR AN ACT ENTITLED: "AN ACT requiring prorated credits or rebates for telecommunications cancellation; Requiring billing notices; and PROVIDING AN IMMEDIATE EFFECTIVE DATE."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
NEW SECTION. Section 1. Service disconnection. A telecommunication carrier shall discontinue service within 2 business days of a customer's request for disconnection unless the customer hinders the carrier's access to equipment needed to disconnect. The carrier shall grant a customer a prorated credit or rebate if the customer requests disconnection 3 or more working days before the end of the monthly billing period.
NEW SECTION. Section 2. Notice of credits and refunds. A telecommunication carrier shall include on each bill for service a notice regarding the customer's right to a prorated credit or rebate on cancellation of service in accordance with [section 1]. The notice must include a contact telephone number.
NEW SECTION. Section 3. Codification instruction. [Sections 1 and 2] are intended to be codified as an integral part of Title 69, chapter 3, part 8, and the provisions of Title 69, chapter 3, part 8, apply to [sections 1 and 2].
NEW SECTION. Section 4. Effective date. [This act] is effective on passage and approval.
