A BILL FOR AN ACT ENTITLED: "AN ACT generally revising laws regarding highway projects; requiring the use of mountable curbing to preserve access to existing businesses; and providing a definition."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

NEW SECTION. Section 1.Mountable curbing -- maintenance of access to existing businesses. (1) When a highway project involves improving or redesigning a highway in an area where existing businesses have driveway access to the highway, the department shall preserve as much of the existing business access as possible through the use of mountable curbing.

(2) For the purposes of this section, "mountable curbing" means curbing that has sloping faces that allows vehicles to encroach on the curbing and access driveways without damaging tires or wheels.

 

NEW SECTION. Section 2.Codification instruction. [Section 1] is intended to be codified as an integral part of Title 60, chapter 5, and the provisions of Title 60, chapter 5, apply to [section 1].
