A BILL FOR AN ACT ENTITLED: "AN ACT requiring notice of construction that will result in obstructions above 200 feet in counties containing air force installations; requiring the cascade county planning department to update the missile field COMPATIBLE use map; and PROVIDING AN APPROPRIATION."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
NEW SECTION. Section 1. Notice requirement. A person or entity planning construction that will create an obstruction 200 feet or greater above ground level in a county containing an active installation operated by the United States air force must provide notice to the Malmstrom air force base civil engineering department and the Cascade County planning department, or any person designated as a representative of those parties, at least 120 days before construction begins.
NEW SECTION. Section 2. Compatible use map. The Cascade County planning department shall maintain the missile field compatible use map and work with the United States department of defense to undertake an update to the existing map in the years 2021 and 2022 to ensure the map reflects current mission requirements.
NEW SECTION. Section 3. Appropriation. There is appropriated $25,000 from the general fund to the Cascade County planning department for the purpose of [section 2].
NEW SECTION. Section 4. Codification instruction. [Sections 1 and 2] are intended to be codified as an integral part of Title 10, and the provisions of Title 10 apply to [sections 1 and 2].
