A BILL FOR AN ACT ENTITLED: "AN ACT REQUIRING EQUAL OPPORTUNITY FOR EXPRESSIVE ACTIVITY PRESENTING OPPOSING, DIVERGENT, OR CONTRADICTING VIEWPOINTS AT PUBLIC POSTSECONDARY INSTITUTIONS; PROVIDING A DEADLINE TO PROVIDE THE EQUAL OPPORTUNITY; and PROVIDING AN EFFECTIVE DATE."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
NEW SECTION. Section 1. Intellectual diversity on campus -- opportunity for alternative viewpoints required. Whenever a public postsecondary institution provides an opportunity for or facilitates expressive activity providing a specific viewpoint, the institution shall provide an equal opportunity for expressive activity providing an opposing, divergent, or contradicting viewpoint. The opportunity for the opposing viewpoint to be presented must be provided within 1 calendar year of the date of the original presentation.
NEW SECTION. Section 2. Codification instruction. [Section 1] is intended to be codified as an integral part of Title 20, chapter 25, part 15, and the provisions of Title 20, chapter 25, part 15, apply to [section 1].
NEW SECTION. Section 3. Effective date. [This act] is effective July 1, 2023.
