A BILL FOR AN ACT ENTITLED: "AN ACT REVISING ELECTION LAWS; REQUIRING A MUNICIPALITY TO HOLD AN ELECTION BEFORE ENTERING A UTILITY GREEN TARIFF WITH A PUBLIC UTILITY; and PROVIDING AN EFFECTIVE DATE."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
NEW SECTION. Section 1. Utility green tariff -- election for authorization. (1) The governing body of a municipality shall put the question of entering a utility green tariff with a public utility to the electors of the municipality.
(2) The election must be held during a general election as defined in 13-1-104.
(3) The election must be held in accordance with the procedures provided in Title 7, chapter 5, part 1, and Title 13, chapter 1, part 4.
NEW SECTION. Section 2. Codification instruction. [Section 1] is intended to be codified as an integral part of Title 7, chapter 13, part 41, and the provisions of Title 7, chapter 13, part 41, apply to [section 1].
NEW SECTION. Section 3. Effective date. [This act] is effective July 1, 2023.
