A BILL FOR AN ACT ENTITLED: "AN ACT REVISING ELECTION LAWS; REQUIRING A MUNICIPALITY TO HOLD AN ELECTION BEFORE ENTERING A UTILITY GREEN TARIFF WITH A PUBLIC UTILITY; and PROVIDING AN EFFECTIVE DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

NEW SECTION. Section 1.Utility green tariff -- election for authorization. (1) The governing body of a municipality shall put the question of entering a utility green tariff with a public utility to the electors of the municipality.

(2)        The election must be held during a general election as defined in 13-1-104.

(3)        The election must be held in accordance with the procedures provided in Title 7, chapter 5, part 1, and Title 13, chapter 1, part 4.

 

NEW SECTION. Section 2.Codification instruction. [Section 1] is intended to be codified as an integral part of Title 7, chapter 13, part 41, and the provisions of Title 7, chapter 13, part 41, apply to [section 1].

 

NEW SECTION. Section 3.Effective date. [This act] is effective July 1, 2023.
