A BILL FOR AN ACT ENTITLED: "AN ACT REQUIRING RULES REGULATING UNATTENDED FIRES CONDUCTED UNDER FIRE HAZARD REDUCTION AGREEMENTS; providing rulemaking authority; and PROVIDING AN IMMEDIATE EFFECTIVE DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

NEW SECTION. Section 1.Fire hazard reduction agreement -- burn rules. (1) Before July 1, 2024, the department shall adopt rules that apply to fire hazard reduction agreements conducted under this part and regulated pursuant to 7-33-2205.

(2)        The rules must contain provisions that allow for a fire to be left unattended when the risk of spreading is highly unlikely, including but not limited to:

(a)        the presence of snow, other moisture, or forecasted moisture;

(b)        no high wind warnings in the immediate forecast; and

(c)        at least one site visit to ensure the risk is minimized.

 

NEW SECTION. Section 2.Codification instruction. [Section 1] is intended to be codified as an integral part of Title 76, chapter 13, part 4, and the provisions of Title 76, chapter 13, part 4, apply to [section 1].

 

NEW SECTION. Section 3.Effective date. [This act] is effective on passage and approval.
