A BILL FOR AN ACT ENTITLED: "AN ACT submitting to the qualified electors of montana an amendment to article VIII of the montana CONSTITUTION TO prohibit THE USE OF PUBLIC FUNDS FOR AN ABORTION SUBJECT TO EXCEPTIONS FOR RAPE, INCEST, OR physical conditions CERTIFIED BY A PHYSICIAN THAT THE WOMAN IS IN DANGER OF DEATH UNLESS AN ABORTION IS PERFORMED; and PROVIDING an effective date."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
NEW SECTION. Section 1. Article VIII of The Constitution of the State of Montana is amended by adding a new section 18 that reads:
Section 18. Prohibition on use of public funds for abortions -- exceptions. (1) Except as provided in subsection (2), public funds or monies may not be expended for an abortion.
(2) The legislature may appropriate funds for an abortion:
(a) when pregnancy is the result of an act of rape or incest; or
(b) in a case in which a woman suffers from a physical disorder, physical injury, or physical illness, including a life-endangering physical condition caused by or arising from the pregnancy itself, that would, as certified by a physician, place the woman in danger of death unless an abortion is performed.
NEW SECTION. Section 2. Two-thirds vote required. Because [section 1] is a legislative proposal to amend the constitution, Article XIV, section 8, of the Montana constitution requires an affirmative roll call vote of two-thirds of all the members of the legislature, whether one or more bodies, for passage.
NEW SECTION. Section 3. Effective date. [This act] is effective on approval by the electorate.
NEW SECTION. Section 4. Submission to electorate. [This act] shall be submitted to the qualified electors of Montana at the general election to be held in November 2024 by printing on the ballot the full title of [this act] and the following:
