A BILL FOR AN ACT ENTITLED: "AN ACT REVISING ELECTRONIC DRIVER'S LICENSE PRIVACY LAW; PROVIDING THAT DISPLAYING AN ELECTRONIC DRIVER'S LICENSE ON AN ELECTRONIC DEVICE DOES NOT CONSTITUTE CONSENT TO A SEARCH OR SEIZURE OF THE ELECTRONIC DEVICE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

Section 1.Displaying electronic driver's license. Displaying an electronic driver's license on an electronic device or handing an electronic device displaying an electronic driver's license to a peace officer does not constitute consent to a search or seizure of the electronic device.

 

Section 2.Codification instruction. [Section 1] is intended to be codified as an integral part of Title 61, chapter 5, part 3, and the provisions of Title 61, chapter 5, part 3, apply to [section 1].
