A BILL FOR AN ACT ENTITLED: "AN ACT revising health insurance laws relating to prior authorization for a health care service for the treatment of a chronic or long-term care condition; Requiring prior authorization to remain valid for the LENGTH of the TREATMENT; and AMENDING SECTION 33-32-107, MCA."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

Section 1. Section 33-32-107, MCA, is amended to read:

"33-32-107. Length of prior authorization. A certification by a utilization review organization approving health care services is valid for at least 3 months from the date the health care provider receives the certification unless the covered person loses coverage under the applicable health plan or health insurance coverage. If a utilization review organization requires a prior authorization for a health care service for the treatment of a chronic or long-term care condition, the prior authorization remains valid for the length of the treatment and the utilization review organization may not require the enrollee to obtain a prior authorization again for the health care service."
