A BILL FOR AN ACT ENTITLED: "AN ACT REVISING LAWS RELATED TO SCHOOL DISTRICTS TO CLARIFY THAT A SCHOOL DISTRICT MAY NOT OPERATE a SCHOOL OR offsite instructional setting OUTSIDE THE BOUNDARIES OF THE SCHOOL DISTRICT; and PROVIDING AN EFFECTIVE DATE and an applicability date."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
NEW SECTION. Section 1. Prohibition on operating school or offsite instructional setting beyond district boundaries. (1) The board of trustees of a school district may not operate a school or offsite instructional setting outside of the school district boundaries.
(2) This section does not limit:
(a) boards of trustees from entering into multidistrict agreements under 20-3-363; or
(b) the provision of offsite educational services under 20-7-118.
NEW SECTION. Section 2. Codification instruction. [Section 1] is intended to be codified as an integral part of Title 20, chapter 6, part 5, and the provisions of Title 20, chapter 6, part 5, apply to [section 1].
NEW SECTION. Section 3. Effective date -- applicability. [This act] is effective July 1, 2023, and applies to school years beginning on or after July 1, 2023.
