A BILL FOR AN ACT ENTITLED: "AN ACT expanding when auxiliary officers may carry a weapon; and AMENDING SECTION 7-32-232, MCA."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

Section 1. Section 7-32-232, MCA, is amended to read:

"7-32-232. Role of auxiliary officers -- when auxiliary officers may carry weapons. (1) Auxiliary officers:

(a)        are subordinate to full-time law enforcement officers; and

(b)        may not serve unless supervised by a full-time law enforcement officer.

(2)        An auxiliary officer may carry a weapon with approval from the officer's supervising sheriff or law enforcement agency head:

(a)        while on an official search and rescue mission; or with prior approval from the sheriff

(b)        after completing related training prescribed by the auxiliary officer's authorizing law enforcement agency."
