A BILL FOR AN ACT ENTITLED: "AN ACT ESTABLISHING REPORTING REQUIREMENTS RELATED TO nonessential employees OF A STATE AGENCY AS DETERMINED BY THE AGENCY; defining "nonessential employee"; and PROVIDING AN IMMEDIATE EFFECTIVE DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

NEW SECTION. Section 1.Biennial report of nonessential employees to appropriate interim budget committee. (1) In each odd-numbered year, and within 30 days of adjournment sine die, each agency shall prepare a report identifying the position titles and job descriptions of each nonessential employee in an electronic format. The report must be presented by the agency in accordance with 5-11-210 to the interim budget committee established in 5-12-501 that oversees that agency's expenditures.

(2)        "Nonessential employee" means an employee that is not essential to the continuation of key operations and services that are provided by a state agency as determined by that agency.

 

NEW SECTION. Section 2.Codification instruction. [Section 1] is intended to be codified as an integral part of Title 5, chapter 12, part 5, and the provisions of Title 5, chapter 12, part 5, apply to [section 1].

 

Coordination SECTION. Section 3.Coordination instruction. If House Bill No. 110 is not passed and approved, then the reference to the interim budget committees in [section 1 of this act] must be changed to the legislative finance committee.

 

NEW SECTION. Section 4.Effective date. [This act] is effective on passage and approval.
