A BILL FOR AN ACT ENTITLED: "AN ACT CLARIFYING the PROHIBITION OF GRAZING PUBLIC LAND WITHOUT PERMISSION; providing a penalty; and AMENDING SECTION 81-4-209, MCA."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
NEW SECTION. Section 1. Grazing public land -- penalty. Nothing in this chapter allows an owner or person in control of cattle or other livestock to willfully graze on state or federal land without applicable permits or leases.
Section 2. Section 81-4-209, MCA, is amended to read:
"81-4-209. Penalty for violations. An owner, person, firm, corporation, or association violating any provisions of 81-4-203 through 81-4-209 or [section 1] shall be is guilty of a misdemeanor punishable as provided in 46-18-212."
NEW SECTION. Section 3. Codification instruction. [Section 1] is intended to be codified as an integral part of Title 81, chapter 4, and the provisions of Title 81, chapter 4, apply to [section 1].
